Cruisetopic is a brand owned by Digitaltrend Italia srl (hereinafter referred to as Cruisetopic) which operates and acts as an intermediary between the Customer and the Cruise Company or Tour Operator and Travel Agency (the Travel Agency includes online travel agencies, hotels, airlines, and travel insurance providers). Therefore, the General Terms and Conditions applied to the cruise you booked may vary depending on the specific Cruise Company.

Thanks to the travel agency license "Cruisetopic of Digitaltrend Italia S.r.l." SCIA REP_PROV_MI/MI-SUPRO/0272239 OF 20/12/2019, insured RC with Europassistance policy no. 4140760 of 21/03/19, and an ordinary member of Fondo Vacanze Felici registration no. 1735 of 16/4/2019, it can operate as a travel intermediary. In the event that Cruisetopic operates as a Tour Operator (for example in booking pre/post cruise packages), the general terms and conditions of sale of the tourist packages approved by FIAVET will apply.

 

Conditions of use of the site

 

Access to this website implies, by the user, acceptance without reservation of the terms and conditions stated below without any exception. Failure to accept any of these General Terms and Conditions prohibits the use of the Website. The site is owned by Cruisetopic. The logo related to each product and/or company mentioned on the Cruisetopic website is the exclusive property of their authors and registrants. Access to the Cruisetopic website is strictly reserved for personal use by users seeking information about cruises. The information provided on this site may be transmitted, reproduced, or printed only for personal purposes. It is strictly forbidden to modify, reproduce, copy, or exploit the Cruisetopic website for commercial purposes. Any use of one or more parts of the site must be authorized in writing by the trademark owner.

All descriptions and information provided on the site are not to be considered definitive, the photographs displayed are purely decorative and do not constitute a contractual element, thus cannot be binding on our responsibility. To verify the details of the cabin you booked, we invite you to consult the shipping company's website directly. Cruisetopic does not guarantee the accuracy of the information provided by the Cruise Companies and is not responsible for changes that may occur regarding photographs, prices, taxes, terms, and conditions. The presence of special offers on the site does not guarantee availability or usability, which is solely under the Cruise Company's competence. Cruisetopic may, at its sole discretion, without notice and for any reason, modify the information contained on the site. Use of the site after modifications constitutes acceptance of any changes that replace the previous terms and conditions.

These changes do not affect obligations and rights arising before them. The use of the site after modifications will be subject to the terms and conditions in force at that time. Despite our vigilance, errors and/or omissions may be present on the site, but in no case can they be attributed to us. Cruisetopic and all those mentioned on this site disclaim any responsibility for damages, whatever their nature, that may result from the use of data from our site; the user is therefore entirely responsible for the use of this information.

 

Modalities of purchase and withdrawal

 

1) Confirmation of the Cruise

 

For each proposed cruise, the acceptance of the offer is subject to:

For the buyer: confirmation made through the acceptance of the general terms and conditions of sale placed on the online contract and sending the balance or deposit stated on the travel contract, with all necessary data of all passengers correctly entered.

From the seller: sending the booking confirmation via email.

The rates related to the prices of all the individual items in the quote/contract will be subject to reconfirmation until Cruisetopic sends the booking confirmation. The published prices are updated directly from the Cruise Companies' database, through XML integrations, and refer to the price for two paying Adults in a double cabin. If payment is made by bank transfer or postal order, it is necessary to send the payment receipt via email.

Due to updating problems or the continuous updating of rates, the published prices must necessarily be reconfirmed by one of our operators. To complete the booking, it is necessary to sign the travel contract and make the deposit or balance payment where applicable. Generally, bookings will be confirmed by paying a 35% deposit at the time of booking and a 65% balance within 35 days before the cruise departure date. This practice may vary depending on the individual cruise companies and the rates applied to the booking. In any case, this practice may be subject to change at Cruisetopic's sole discretion. If the contract provides for the addition of flights to reach the departure and return destination, the flight price must be paid 100% by the customer at the time of booking confirmation. Whether the flight is provided by the shipowner or by Cruisetopic, from the moment of confirmation, the flight amount will be subject to a 100% penalty and non-refundable.

Cruisetopic is not in any way responsible for the assignment of cabins and/or categories/experiences. The cabin is assigned by the shipowner's designated office, Cruisetopic has no authority to modify or intervene in the assignment process. The cabin number taken at the option stage cannot be guaranteed as the shipowner has the right to modify it at any time. For guaranteed multiple cabins, it is possible that the shipowner assigns more double cabins. In the event that the shipowner provides a flight package included in the travel package, Cruisetopic cannot be held responsible for any changes to the flight operations imposed by the shipowner itself. Cruisetopic undertakes to communicate such changes at least 15 days before the customer's departure date.

The prices published on the Medium and Long-haul offers generally refer to the cabin price only, excluding flights, taxes, and insurance. Their use could be subject to the purchase of the charter flight provided by the shipowner. It is the buyer's responsibility to verify before departure that they have the required identity document (including any necessary visas, including ESTA admission issuance for the United States of America, available on the website https://esta.cbp.dhs.gov/) for the chosen cruise and to check its expiration date. If a guest does not have the required document, they will not be able to board and will not be entitled to any refund. Cruisetopic and its partners will be held harmless from any failure on the part of the customer in verifying identity documents, visas, or any other type of document required to pass customs and border controls.

The prices may sometimes include a service fee for the consultancy provided in choosing the best travel solution by Digitaltrend Italia srl, which owns the Cruisetopic group. This service is rendered directly by Digitaltrend Italia srl. Payment will still be made together with the cost of the purchased tourist services for the buyer's convenience. The buyer will still have the possibility to request a receipt for the payment directly from Digitaltrend Italia srl.

As for insurance coverage, Cruisetopic offers all customers the Happy Cruise Card which includes the following services:

  • Cancellation-Medical-Baggage Insurance
  • Dedicated assistance with direct customer service
  • Direct post-sale assistance phone number (WUP)
  • Preview of special conditions and promotions from cruise companies.

This card, in case of cancellation, is never refundable.

 

2) Payment of the Cruise

The following forms of payment are accepted

  • BANK TRANSFER
  • CREDIT CARD

BANK TRANSFER:

In the event that payment is made by BANK TRANSFER it will be necessary to send the payment receipt by email.
In the event that the departure date of the chosen cruise is less than 10 working days away, ordinary bank transfers will not be accepted, but only INSTANT BANK TRANSFERS.

CREDIT CARD:

In the event that payment is made by CREDIT CARD the customer may choose to make the transaction over the phone with the assistance of one of our operators or be redirected to the bank's website to process the payment and authenticate the transaction in 3D SECURE.

In the event that the customer has decided to make a multiple or installment payment of his/her cruise, the only form of payment allowed will be CREDIT CARD. This payment method will be used on the contractual due dates automatically by the virtual POS.

In the event that the customer wishes for whatever reason to change the method of payment, such a change will only be permitted within 5 working days before each set deadline. The request must be sent by email to: CUSTOMERSERVICE@CRUISETOPIC.NET.

In the event that the planned automatic payments by credit card are not successful, the customer shall have 24 hours to replace the credit card or make the balance payment by BANK TRANSFER. If the payment is not received within the time limit Cruisetopic will automatically be authorised to cancel the booking and charge any penalties accrued.

If the booking is paid with a credit card belonging to a third party, we reserve the right to request written authorisation from the card holder as well as a photocopy of the identity document and a photocopy of the credit card. All e-mail addresses used must be valid at the time of booking.

In an effort to minimise the effects of credit card fraud, Cruisetopic reserves the right to carry out random checks, and to ask for proof of your address and/or a copy of your credit card before issuing the booking confirmation.

In order to provide greater security, you will be asked to enter all the information on your card for each purchase made through the Cruisetopic website. The contract holder authorises Cruisetopic to use the credit card information provided, even after the booking request has been made:

In order to make the payment of the requested services and agency fees possible,

1.for the payment of any insurance fees,

2.for the processing of any refunds,

3.for the payment of agency fees due for services requested post-booking,

4.for the payment of the balance of the booked cruise in the case of a down payment and a balance after the booking date.

5.payment of monthly installments for the balance of the cruise

 

3) Cancellation or modification of the cruise

 

The possibility of cancelling or modifying a booked product or service, and the relevant terms and conditions, will depend exclusively on the specific terms and conditions indicated in the following tables. Some special and promotional fares have different terms and conditions from the general ones. Therefore, it may not be possible to cancel or modify certain products or services without penalty. In the event of cancellation or modification of a reservation, Cruisetopic will charge €100,00 per passenger as "administrative handling fee" in addition to the penalties.

When booking flights through Cruisetopic, an issuing commission of 20,00 € per ticket will be requested and the sales conditions dictated by each airline will be applied according to the type of ticket. Before concluding the booking of your cruise, you can check the General Conditions on our websites.

The buyer agrees to read these documents and declares, by accepting the purchase contract, to have read the full terms and conditions of sale and to accept them.

There is no right of withdrawal. The right of withdrawal is exercised pursuant to and for the purposes of art. 64 et seq. of Legislative Decree 206/05 and art. 36 et seq. of Law 9902/2008 (Consumer Code). Beyond its generic and consolidated civil law nature, the Consumer Code has recognized the consumer, for contracts concluded at a distance and off-premises, the right to withdraw unilaterally from the contract entered into for the purchase of goods and services. However, the right of withdrawal can not be exercised by the consumer, inter alia, to services relating to accommodation, transport, catering, leisure, when there is a date or a specified period for the supply (eg by reservation), provided that such provisions are written on the contract and, therefore, the consumer is aware of it. A fortiori is not provided for the right of withdrawal, by the consumer, according to the coordinated provision of Article 55 paragraph 1, letter b) and the following paragraph 2 letter a) and art. 37/8/h of the Consumer Code.

All cancellations or changes to the quotes booked with the use of a Voucher following the Decree of 25-03-2020 regarding Covid19, will be subject to a 100% Penalty Fee (the validity of the Voucher is 24 months from the date of issue).
In the event of modification or cancellation of previously modified bookings, the applicable cancellation and modification conditions are 100%.

GENERAL CONDITIONS OF CANCELLATION

In case of cancellation, management fees equal to 10% of the total trip cost will be charged, with a minimum of €100.00 per passenger in addition to the cost of the Happy Cruise Card.

Cancellation Penalties:

  • More than 120 days before the departure date: 10% of the total trip cost (with a minimum of €100 per passenger)
  • From 120 to 91 days before the departure date: 25% of the total trip cost
  • From 90 to 61 days before the departure date: 50% of the total trip cost
  • From 60 to 31 days before the departure date: 75% of the total trip cost
  • Less than 30 days or no show at embarkation: 100% of the total trip cost

Special cancellation conditions for cruises lasting 15 days or more:

  • Up to 61 days before departure as per the previous indicative table, less than 61 days before departure the penalties are 100% of the total trip cost.

In case of cancellation of a booking with MSC Cruises, Cruisetopic will retain the registration fees. This non-refundable amount will be added to the applicable penalties.

Any modification request (passenger names, travel title, cabin occupants, etc.) will incur administrative processing fees of €100.00.

In any case, reference will be made to the special conditions of the individual companies listed below if they are worse than the general cancellation conditions.

  • From 50 days before the departure date or no show: 100% of the total trip cost

Any modification request (passenger names, travel title, cabin occupants, etc.) will incur administrative processing fees of €100.00.

  • From confirmation up to 270 days: 20% of the total
  • From 269 days to 90 days: 30% of the total trip cost
  • From 89 days to 30 days: 55% of the total trip cost
  • From 29 days to 10 days: 80% of the total trip cost
  • From 9 days to 0 days: 100% of the total trip cost

AZAMARA CONDITIONS

  • More than 120 days before the departure date: 25% of the total trip cost (with a minimum of €90 per passenger)
  • From 120 to 91 days before the departure date: 40% of the total trip cost
  • From 90 to 61 days before the departure date: 60% of the total trip cost
  • Less than 60 days or no show at embarkation: 100% of the total trip cost

CUNARD CONDITIONS

  • More than 120 days before the departure date: 25% of the total trip cost
  • From 120 to 31 days before the departure date: 50% of the total trip cost
  • Less than 30 days or no show at embarkation: 100% of the total trip cost

HOLLAND CONDITIONS

  • More than 120 days before the departure date: 25% of the total trip cost
  • From 120 to 31 days before the departure date: 75% of the total trip cost
  • Less than 30 days or no show at embarkation: 100% of the total trip cost

NORWEGIAN CRUISE LINE CONDITIONS

  • More than 120 days before departure: 30% of the total cruise cost per passenger
  • From 120 to 91 days before the departure date: 75% of the total cruise cost per passenger

OCEANIA CRUISES CONDITIONS

  • From confirmation to 151 days before the departure date: 25% of the total trip cost
  • From 150 to 121 days before the departure date: 50% of the total trip cost

  • Less than 90 days before the departure date: 100% of the total trip cost

  • More than 215 days before departure: 25% of the total trip cost

  • More than 215 days before departure: 25% of the total trip cost

REGENT CONDITIONS

Cruises of 14 nights or less:

  • Up to 151 days before departure: 25% of the total trip cost
  • From 150 to 91 days before departure: 30% of the total trip cost
  • From 91 to 76 days before departure: 60% of the total trip cost
  • Less than 76 days before departure: 100% of the total trip cost

Cruises of 15 nights or more:

  • Up to 151 days before departure: 25% of the total trip cost
  • From 150 to 121 days before departure: 50% of the total trip cost
  • From 91 to 120 days before departure: 75% of the total trip cost
  • Less than 90 days before departure: 100% of the total trip cost

REGENT - WORLD TOUR CONDITIONS

  • More than 151 days before the departure date: 25% of the total trip cost
  • From 150 to 121 days before the departure date: 50% of the total trip cost
  • From 120 to 91 days before the departure date: 75% of the total trip cost
  • Less than 90 days or no show at embarkation: 100% of the total trip cost

SILVERSEA CONDITIONS

  • More than 120 days before the departure date: 25% of the total trip cost
  • From 120 to 91 days before the departure date: 75% of the total trip cost
  • Less than 90 days or no show at embarkation: 100% of the total trip cost

PRINCESS CRUISES CONDITIONS

  • More than 120 days before the departure date: 40% of the total trip cost
  • From 120 to 91 days before the departure date: 75% of the total trip cost
  • Less than 90 days or no show at embarkation: 100% of the total trip cost

CARNIVAL CONDITIONS

  • Cancellation penalties are 100% starting from the booking confirmation.
  • Any modification to the contract (passenger replacement, cabin occupancy, etc.) will be charged 100%.

MSC CRUISES CONDITIONS

  • Cancellation penalties are 100% starting from the booking confirmation. Any modification to the contract (passenger replacement, cabin occupancy, etc.) will be charged 100%.

MSC YACHT CLUB CANCELLATION CONDITIONS (excluding world tour)

  • Up to 120 days before departure: €200 per person
  • Between 119 and 90 days before departure: 35% of the cruise price
  • Between 89 and 60 days before departure: 50% of the cruise price
  • Between 59 and 30 days before departure: 80% of the cruise price
  • Between 29 and 15 days before departure: 100% of the cruise price
  • Less than 30 days before departure: 100% of the cruise price

Payment of the trip at 90 days before departure

A tariff adjustment may be applied to the dossier in case of partial cancellation.

SPECIAL GROUP CANCELLATION CONDITIONS

  • More than 150 days before the departure date: 20% of the total trip cost
  • From 149 to 90 days before the departure date: 30% of the total trip cost
  • From 89 to 60 days before the departure date: 60% of the total trip cost
  • Less than 60 days before the departure date: 100% of the total trip cost

SPECIAL CANCELLATION CONDITIONS FOR "WORLD TOUR" CRUISES (cruises of 42 nights or more) or grand Africa cruise

  • More than 120 days before the departure date: 25% of the total trip cost
  • From 120 to 91 days before the departure date: 50% of the total trip cost
  • From 90 to 61 days before the departure date: 75% of the total trip cost
  • From 60 days before the departure date or no show: 100% of the total trip cost

In case of refund, the waiting time is 90 days

SPECIAL CONDITIONS FOR HAMILTON AND ORANGE SUPPLIERS FOR CRUISES

All bookings made through the aforementioned suppliers and for all cruises identified with PSM in the purchase contract description will be subject to a 100% penalty from the time of booking.

Sending of travel documents

Cruisetopic relies on the accuracy of the information provided by the customer; therefore, it cannot be held responsible for the loss of paper documents caused by an incorrect address or for the non-delivery of e-tickets due to incorrect email addresses, incorrect email program installation, spam filters, or Internet network malfunctions. It is the customer's duty to promptly communicate any changes to email addresses or phone numbers. Customers are also requested to verify that the name on passports or identity cards matches the one on the travel ticket. It is the customer's responsibility to promptly notify Cruisetopic of any inaccuracies in all passenger data. If the non-receipt of customer documents is not reported well in advance, and in any case not before seven days before the departure date, Cruisetopic cannot guarantee timely delivery of replacement tickets.

Authorization to use data

User data may be used to offer the highest possible level of service and to contact them in case of changes to the purchased travel program, such as flight schedule changes, delays, etc. Additionally, user data may be used to update them on our products and services, special offers and promotions, and to send informative material of possible interest. Commercial communications will be sent via email, fax, MMS, or SMS only with the user's consent. Even if such communications may occasionally contain information about third-party products, these third parties will not contact users directly unless explicitly requested.

Cruisetopic undertakes not to disclose users' data to third parties, except where necessary to complete a booking, purchase, or any request made through the website, or as provided in this information. We are also required to disclose users' personal data in all cases provided by law, and this data may also be communicated to third parties and professional advisors acting on our behalf and who are nevertheless obliged to maintain confidentiality.

User data may be shared with Cruise Companies or Tour Operators and Travel Agencies when the user makes a booking request to enable the booking and provide our products or services requested by the user. Depending on the request, this information may include the user's name, contact details, passport data, booking or travel itinerary details, preferences, any special requests or accommodations, information or comments the user chooses to provide (if any), and other information required by the specific Cruise Companies or Tour Operators and Travel Agencies.

User data may be shared with our group companies. We share the user's information with our affiliates and subsidiaries. We may share the user's information with our group companies for the following reasons: (i) to provide the user with integrated services (including administering and managing bookings, services, and payments on all our affiliated platforms); (ii) to provide personalized offers or send marketing communications to the user with their consent or as permitted by applicable law; (iii) to analyze how users use affiliated and independent platforms, allowing us, for example, to improve existing products and services and develop new products, services, and features that may be relevant to our users; (iv) to ensure compliance with applicable regulations; (v) to provide customer support services; (vi) to detect, prevent, and investigate fraud and misuse of our services and products, other illegal activities, and data breaches.

Additionally, we share the user's information to process payments. To use certain services and products (e.g., booking a cruise) and to make payments to Cruise Companies or Tour Operators and Travel Agencies, we need payment information (e.g., credit or debit card details, information about other online payment methods, etc.). When the user submits their payment information through our services, we share this information with the relevant Travel Agency or Cruise Company, external companies that manage payments, and other third-party service providers (including, but not limited to, companies that provide fraud detection services to us and other third parties) to the extent necessary to fulfill our contractual obligations to the user (e.g., to ensure a booking or make a payment where necessary), to meet our legitimate interests in preventing fraud and other misuse of our platforms or services, or with the user's consent where required by law. In particular: (i) when the user uses a credit or debit card to guarantee a booking through our services, we provide the credit or debit card details (including card number and expiration date, and if required by the Cruise Companies or Tour Operators and Travel Agencies, CVV number) to the relevant Travel Agency or Cruise Company to process the transaction. (ii) when the user provides their credit or debit card details through our services, they have the option to save these details in their account for future use. If they choose not to save the credit or debit card details in their account, we will delete these details once the transaction is completed.

Cruisetopic also uses "cookies" to collect information on how users use the website. Cookies are text files used for statistical purposes without any intent to harm or violate privacy and allow temporary storage of information within your PC: this allows us to recognize the computer used to access the website www.Cruisetopic.roAll information contained in the Cookies will not be used for any purpose other than those stated above. Most PCs automatically accept cookies: you can still delete existing cookies on your PC. You can also change the options so as not to receive cookies in the future.

Online Contract Regulations

Specific legal articles related to "online" sales, extracted from the "Tourism Code." Legislative Decree of 23 May 2011 no. 79 ART. 32 (Scope of application) and Art. 3 (Subjects and scope of application) Art. 4 (Definitions) of Law no. 93/2015 (Tourism Code).

Companies that carry out commercial activities in the tourism sector, on a contractual basis, outside the territory of the Italian Republic, must act in accordance with the provisions of Italian legislation, provided they do not contravene the laws of the State in which these activities are carried out.

The provisions of this chapter apply to tourist packages defined by Article 34 and Article 4.21, sold or offered for sale to anyone by the organizer or intermediary, referred to in Article 33. 2 and Article 4. 1 (Tourism Code). This chapter also applies to tourist packages negotiated outside commercial premises or at a distance. The provisions of Articles 64 to 67 of Legislative Decree 6 September 2005, no. 206, and Articles 36 to 37/6 of Law no. 9902/2008 (Consumer Code) remain unchanged. In such cases, the professional is obliged to communicate in writing the exclusion of the right of withdrawal. Failure to communicate about the non-existence of the right of withdrawal results in the applicability of Articles 64, 65, 66, and 67 of Legislative Decree 6 September 2005, no. 206, and Articles 36 and 37/1, 37/3, 37/4, 37/5, and 37/6 of Law 9902/2008.

For matters not provided for in this chapter, the provisions of Legislative Decree 6 September 2005, no. 206, and Law no. 9902/2008 (Consumer Code) apply. The online sale of online tourist services falls within the so-called "Electronic Booking," the proposals on the site are defined as an electronic catalog. Confirmation occurs with a click (so-called point-and-click contract). Cancellation of booking and any penalties must be provided (Art. 1382 of the Civil Code "penalty clause" and Art. 541 of the Civil Code). Distance contracts are also defined by the Consumer Code Article 50 letter a and Article 37), the provisions of Article 52 and Article 36 of the same code, relating to the obligation to inform the customer, apply. Therefore, these are contracts with electronic execution, which provide for an integration of the rules of the Consumer Code with the rules of electronic commerce (Article 68 of the Consumer Code, which refers to Legislative Decree 9 April 2003, no. 70 - Implementation of Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the internal market and Article 37.9 of Law no. 9902/2008).

The right of withdrawal is exercised pursuant to and for the purposes of Art. 64 and ss. of Legislative Decree 206/05 and Art. 36 and ss. of Law no. 9902/2008 (Consumer Code). Beyond its generic and consolidated civil nature, the Consumer Code has recognized the consumer's right to unilaterally withdraw from the contract concluded for the purchase of goods and services for distance and off-premises contracts. However, the right of withdrawal cannot be exercised by the consumer, among other things, for services related to accommodation, transport, catering, leisure when a date or a specific period for the provision is set (for example, with a reservation), provided that these provisions are written in the contract and, therefore, the consumer is aware of them. For this reason, the right of withdrawal is not provided for the consumer, according to the combined provisions of Art. 55, paragraph 1, letter b) and Art. 37/8/h of Law no. 9902/2008 of the Consumer Code (last-minute and last-second contracts - as it falls within the 10-day limit).

Limitation of liability for the use of the site
